Three-level authentication, also known as consular authentication, is based on international practices and Chinese consular procedures. The purpose of consular authentication is to ensure that documents such as notarized certificates issued by one country are recognized and legally effective in another country, preventing any doubts about the authenticity of the seals and signatures on the documents from affecting their legal validity. The Chinese Embassy (Consulate General) in the United States can provide consular authentication (also known as three-level authentication) for notarized certificates or other proof documents issued by relevant U.S. authorities and authenticated by the U.S. Department of State or the Secretary of State of each state, intended for use in China.
Three-Level Authentication of Birth Certificates, Consulate Authentication
According to international rules, a child's birth in the United States is not automatically recognized in China. A U.S. birth certificate is only valid within the United States. Once in China, even if translated into Chinese, it holds no legal effect. Therefore, it must undergo three-level authentication at the county, state, and consulate levels to register the U.S.-born child in China, apply for a one-time exit-entry permit, and claim maternity benefits.
When you return to China, especially in situations requiring proof of the child's birth or parent-child relationship—such as registering the child's household in China, applying for a one-time exit-entry permit, enrolling in school, extending a visa, or opening a bank account for the child—you may be required to present a birth certificate with consular authentication.
To obtain authentication from the Chinese Consulate, and as more parents are now required by domestic authorities to provide Chinese translations, the recommended steps are as follows:
- 1. First, have the official birth certificate translated into Chinese;
- 2. Then, have the document notarized;
- 3. Next, submit it for state government authentication;
- 4. Finally, submit it to the Chinese Consulate for authentication.
In the United States, three-level authentication is commonly required for marriage certificates and birth certificates.
How to Obtain a Birth Certificate?
When the hospital provides you with the medical birth certificate, they usually include an additional note with an address and phone number, instructing you to call a week after discharge to inquire if the legal birth certificate is ready for pickup. In fact, it’s not exactly "picking up"—it’s more like purchasing it.
After the child is born, the doctor submits the birth information to the Office of Vital Statistics. This process takes about a week. The office verifies the information, enters the child’s details into the database, issues a Social Security number, and forwards the information to the county government’s records management department (in the U.S., counties are larger than cities; Los Angeles County, for example, is a large county encompassing many cities).
Once you can confirm with the Office of Vital Statistics that the birth certificate is ready, you can go to the address provided by the hospital to purchase it. For children of U.S. citizens, one copy is usually sufficient.
However, for parents who are not U.S. citizens and come to the U.S. to give birth, it is generally recommended to purchase three copies (photocopies are invalid). This is because the birth certificate may be needed in the future for household registration in China (if desired), school enrollment, medical treatment, marriage, or childbirth. Therefore, most people buy three copies to be prepared for any situation.
Additionally, please note that the Social Security number will be mailed to the address registered at the hospital about two weeks after the child’s birth. It arrives as a regular letter containing a piece of paper with the child’s name and Social Security number. This document must be kept safe, as it is very important.
