How to Obtain Overseas Chinese Identity Certification and Notarization in the United States

Authentication of a foreign passport, "Green Card," or other valid foreign residency documents is generally used to verify an applicant's overseas Chinese identity or handle related matters within China. It is primarily required for processes such as confirming overseas Chinese status in China, transferring personal assets abroad, assisting relatives or friends with employment or education applications, and applying for family members to settle overseas.

Relevant Government Regulations

1) The Chinese Overseas Chinese Affairs authority's "Interpretation (Trial) of 'Settling' in the Definition of Overseas Chinese" has relaxed the definition of "settling" ("overseas Chinese"): Settling refers to Chinese citizens who have obtained long-term or permanent residency rights in their country of residence; Chinese citizens who have not obtained long-term or permanent residency rights but have held a legal residency permit in their country of residence for five consecutive years and reside abroad are also considered as settled. Chinese students (including government-sponsored and self-funded) studying abroad and public servants (including labor personnel) working abroad are not considered settled.

2) According to the new regulations, residing abroad in a non-student capacity for five consecutive years or more qualifies one as an overseas Chinese.

Methods for Authenticating Overseas Chinese Identity

1) For Green Card holders: Directly notarize and authenticate the Green Card.

2) For non-Green Card holders: Submit a declaration or authenticate documents such as a U.S. driver's license.

3) Authenticate a U.S. passport.

What Documents Are Required for Passport or Green Card Authentication?

1) Consulate notarization and authentication application form.

2) A copy of the applicant's passport.

3) Relevant supporting documents.
