According to the definition in the "Interpretation of 'Settling' in the Definition of Overseas Chinese (Trial)" issued by the Chinese Overseas Chinese Affairs Department on November 8, 2005:

Qualified (eligible for overseas Chinese status):
- "Settling" refers to Chinese citizens who have obtained long-term or permanent residency in their country of residence.
- Chinese citizens who have not obtained long-term or permanent residency but have held a legal residence permit in their country of residence for five consecutive years and reside abroad are considered as settled.
- According to the new regulations, residing abroad for more than five consecutive years under a non-student status qualifies one for overseas Chinese status.
Not Qualified (not eligible for overseas Chinese status):
- Chinese students studying abroad (including government-sponsored and self-funded) are not considered as settled during their study period.
- Chinese citizens working abroad on official assignments (including labor personnel) are not considered as settled during their work period.
Please note that the determination of overseas Chinese status is not handled by consulates but by domestic overseas Chinese affairs departments.
Methods for Obtaining U.S. Residence Proof
- U.S. Green Card Holders: Notarization and authentication of a "certified copy" of the green card.
- Applicants Without a U.S. Green Card: Notarization and authentication of a declaration stating U.S. residence details, including the date and status of entry, place of residence, and any changes in status (e.g., obtaining a green card, switching to H1B).
Regardless of the method, consulates no longer directly determine an applicant's "overseas Chinese status" or provide additional documentation to prove or acknowledge their residence facts. Domestic overseas Chinese affairs departments will assess overseas Chinese status based on the residence proof documents (residence notarization or authentication) provided by the applicant.
