If you are a Chinese citizen holding a valid Chinese ID card, you may use video notarization for faster processing. This service is not available to foreign nationals. Additionally, only single-person authorizations are accepted; joint authorizations are not permitted. For property transaction-related matters, the authorization must be granted to a relative, and proof of relationship must be provided. If you are unable to return to China in person to handle property transaction procedures, you may draft a Power of Attorney for Property Transactions to authorize a relative or friend in China to act on your behalf. In addition to notarizing and authenticating the Power of Attorney, some regions may also require authentication of documents such as passports or green cards. If you have changed your name in the United States, authentication of the name change document is generally required as well. Since requirements vary by location, please consult the relevant domestic authorities first to clarify which documents are needed and which require authentication. This will help you complete the process efficiently, saving time, effort, and money.

Required Materials for Notarization and Authentication of U.S. Property Transaction Power of Attorney

1) Completed "Notarization and Authentication Application Form"
2) Proof of property or assets, such as copies of property deeds, purchase contracts, down payment invoices, bank passbooks, stock account opening documents, etc.
3) Copy of the principal's passport (Chinese citizens must also provide a copy of their U.S. legal residency proof, such as a green card, I-20, H1B, etc.)
4) If married, copies of the spouse's passport and proof of residency abroad
5) If married, a copy of the marriage certificate
6) Copy of both sides of the authorized representative's ID card
7) Copy of the property deed

Procedure for Notarization and Authentication of U.S. Property Transaction Power of Attorney

The following steps outline the three-level authentication process. You may adjust the procedure based on your specific situation.

1. Draft the Property Transaction Power of Attorney and have it notarized by a local notary public. (Agency service available)

2. Secretary of State Authentication (Agency service available)

Secretary of State authentication comes in two types: Certificate and Apostille. For documents intended for use in China, a Certificate is required. If the authentication type is Apostille, the Chinese Embassy or Consulate in the United States will not accept it. Processing times vary by Secretary of State office, typically taking 2–3 weeks. Some states offer expedited services, while others do not. (For specific processing times by state, please contact customer service for details.)

3. U.S. Department of State Authentication Required for the Washington D.C. Embassy Jurisdiction (Agency service available)

Currently, the Department of State authentication process takes longer, usually 3–4 months, significantly increasing the difficulty of the application. You may entrust us to handle this step on your behalf.

4. Authentication by the Chinese Embassy or Consulate in the United States (Agency service available)

Submit the Secretary of State-authenticated or Department of State-authenticated U.S. Property Transaction Power of Attorney to the Chinese Embassy or Consulate in the United States to complete the final authentication step.
